2006年10月技术移民的部分变化
<P>1.Skilled Occupation List(form 1121i)的变化: </P><P>Child Care Co-ordinator自从加入MODL后,一直是VETASSESS负责评估的,现转为60分职业,评估机构也做了相应的调整,由Vetassess换为TRA.这意味这,申请者无法再投机通过VETASSESS评估获得MODL的加分.</P>
<P>2.依亲担保类移民的一些变化:</P>
<P>138/881类: 如果澳洲有亲属的一方无法满足条件,可以通过满足条件的配偶做为主申请(原来是必须有亲属的一方做主申请,即使是通过配偶的条件来获得skills 的评分)</P>
<P>496类(由139转换而来): 澳洲有亲属的一方如果无法满足基本条件,即使配偶满足条件,也无法符合该签证申请的要求。换而言之,必需主申请在澳洲有亲属,而且满足基本要求,才能符合资格。</P>

As announced more than a year ago the Skilled - Designated Area Sponsored visa (subclass number 139) ceases to be a migration pathway from the end of June 2006. </P>
<P>Details of its replacement have been published today ... </P>
<P>- From the 1st of July 2006 skilled visa applicants who have a close family member living in a "Designated Area" will be able to obtain an Australian permanent residency visa in a two stage process. </P>
<P>- The initial application will be for a Skilled Designated Area Sponsored (Provisional) visa, subclass number 496. </P>
<P>- The 496 visa will not be points tested. </P>
<P>- To be eligible for the grant of a 496 visa an applicant for that visa will need t </P>
<P>* be under 45 years of age;
* have good English skills;
* have recent skilled work experience;
* be sponsored by an eligible relative living in a designated area of Australia; and
* have skills and qualifications assessed by a relevant assessing authority as suitable for an occupation on the Skilled Occupation List (the SOL) </P>
<P>- Application for permanent residency will be made via the Skilled Designated Area Sponsored (Residence) visa, subclass number 883. </P>
<P>- To apply for the permanent 883 visa the applicant must: </P>
<P>* have held the provisional 496 visa for at least two years;
* be sponsored by an eligible relative;
* have lived in a designated area for two years;
* have worked full-time in a designated area for at least 12 months; and
* have good English skills. </P>
<P>It should be noted that applicants with close family living in Australia can still apply for the points tested Skilled Australian Sponsored visa (subclass number 138) - the 138 visa provides for permanent residency status upon visa grant and would therefore usually be a preferred visa pathway if there is a choice between the 138 visa and the new 496 visa. </P>
<P>Note - the new 496 visa will probably be categorised as a temporary residency visa and as such 496 visaholders may be able to make use of the new tax provisions commencing 1st July, 2006 affecting temporary residents, in which investment income and capital gains arising outside Australia will not be taxable in Australia.

Two year study rule
How is the two year study requirement changing?
The two year study requirement was introduced in recognition of the value of Australian study in equipping visa holders to find skilled employment and settle easily in Australia. The value arises not only from having an Australian qualification but from having substantial exposure to Australian society and culture.
The current two year study requirements have resulted in some confusion for applicants.
From 1 September 2007, to meet the two year study requirement, applicants will have to complete one or more degrees, diplomas or trade qualifications for award by an Australian educational institute as a result of a course or courses:
• registered on the Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS)
• completed as a result of at least two academic years’ study or completed in a total of no less than 16 calendar months
• that the applicant studied in Australia, while holding a visa that allowed study and for which all instruction was conducted in English.
These changes benefit students because they allow more flexibility. Students will not be penalised for changing education providers provided they obtain credit for their previous study and this study was in a CRICOS registered course undertaken in an Australian institute while physically present in Australia and in accordance with any visa conditions. They will also be able to count study undertaken online towards meeting the two year study requirement (up to 25%), if they were in Australia for the duration of that period of study.
What is two academic years?
To demonstrate that you have studied for at least two academic years, you must show that you have completed the equivalent of two years study at 100% of a full-time load. If you are given credit from prior learning it will reduce the amount of study you have completed.
The department will use CRICOS to determine the standard duration of a course. A course that has a registered duration of 104 weeks is considered to be a two year course.
Examples:
• If a course is CRICOS registered for 156 weeks (3 years) and consists of 24 subjects, 100% of full-time enrolment would equate to 4 units per semester. In that course, a student will have completed two academic years when they have successfully completed 16 subjects.
That means a student enrolled in that course can be given credit for prior learning for up to 8 subjects and still complete two academic years study.
• If a course is CRICOS registered for 104 weeks (2 years) and consists of 12 subjects, 100% of full-time enrolment would equate to 3 units per semester. Students would be required to complete all 12 subjects to meet the two year study requirement.
A student enrolled in this course who is given any credit for prior learning will not have completed two academic years study and may have to complete an additional degree, diploma or trade qualification to meet the two year study requirement. Immigration SA is now in the final stages of testing the new online application system for South Australian Government Sponsorship for the Skilled Sponsored (permanent) and Skilled Sponsored Regional (provisional) visas. [b]The system will go online in the week commencing Tuesday 2nd October [/b](taking into account a State public holiday on Monday 1st October). [b]The occupation lists will be uploaded at the same time.

[b]New labour agreement arrangements for the on-hire industry in Australia will be introduced on 1 October 2007. [/b]What is the new arrangement?
From 1 October, Australian on-hire firms who seek to recruit overseas workers to hire out to unrelated businesses will need to request access to a labour agreement that has been developed to better meet the needs of the on-hire industry. This replaces current access arrangements through the Subclass 457 standard business sponsorship programme.
The labour agreement, which has been specifically tailored for the on-hire industry, provides the on-hire industry with a clear and defined pathway for the recruitment of skilled overseas workers.
On-hire firms seeking to recruit overseas workers to fill positions within their own organisation can continue to use standard business sponsorship arrangements.
